It looks like it was taken in a public setting (so no expectation of privacy) and he's not using it for material gain, so I think it's legal.

Agreed 100%. She looks fine. (Heather: Seriously. YOU LOOK FINE!) She has good pictures and bad pictures like everyone else. She's only egging on her detractors by allowing it (publicly) to be a sore spot.
