The biggest mistake Art made, next to picking Heather, was not enforcing the advice he would give to those beginning in radio. He would say to be yourself but allowed Heather to copy everything he did.

i am in a grey area. i do not record or distribute; nor do i charge for the service. i fall under the "live performance" clause. 

heather does record, does distribute  the recording, and charges for said recording (4.99 month as i understand it).
therein lies the difference.

the music used in the podcast that @DynamoHum , @ponyboysunset  and i do is licensed legally, and that license is paid for.

My father in law needs to pay monthly to have live music in his restaurant so I don't know how streaming music without having to pay is legal no matter how many are doing it. I will research live performance and I am willing to admit if I am wrong though.

Well there are pay services like Sirius which gives you live stream without commercials. That doesn’t mean anything. He’s just paying for that service. Also he is using it for business which makes money. It is part of the dining expierence which is monetized. That could be the difference
